1. About VibePop

VibePop is a personalized digital gift studio that creates custom songs and delivers them through a cinematic gift experience. We operate at vibepop.co.

Every song VibePop creates is produced using a combination of human creative direction and AI-assisted music production technology. Every lyric is written with your specific story in mind. The technology we use to produce the final audio is a tool — the storytelling, the craftsmanship, and the creative decisions are human.

2. The Service

What we deliver

When you place an order with VibePop you receive one or more of the following depending on your selected tier:

• A personalized song created specifically for the recipient you describe, produced based on the story, details, and creative direction you provide in the intake form.
• A themed gift page accessible via a unique private link, designed to create an emotional experience for the recipient and including the song player, your personal message, and the recipient's name.
• A private share link with an optional passcode that you control.
• A digital artwork file where included in your selected tier.
• A printable lyrics card where included in your selected tier.
• An MP3 download of the finished song where included in your selected tier. Songs delivered as MP3 downloads are yours to keep, share, and play personally for the rest of your life.
• Streaming platform distribution where included in the Legacy tier, subject to the additional terms in Section 7 below.

What we do not deliver

VibePop does not deliver physical products of any kind. All deliverables are digital.

VibePop does not guarantee any specific emotional response from recipients.

3. Ordering and Payment

How orders work

Orders are placed through the VibePop website. After selecting your tier and completing payment you will be directed to an intake form where you provide the story, details, names, style preferences, and any other information needed to craft your song. The quality and personalization of your song is directly tied to the detail you provide. The more specific and personal the information, the more specific and personal the song.

Payment

All payments are processed securely through a third-party payment processor. VibePop does not store your payment card information. All prices are in US dollars. Payment is due in full at the time of ordering.

Delivery timeframe

All orders are delivered within 24 hours of your completed intake form submission. The 24-hour clock begins when you submit your intake form, not when payment is made. If we are unable to deliver within 24 hours we will notify you by email and provide an updated delivery estimate.

We are not responsible for delays caused by you failing to submit the intake form after payment.

4. Cancellations and Refunds

Before intake form submission

If you have paid but not yet submitted your intake form you may request a full refund within 2 hours of payment by contacting us at contact@vibepop.co. After 2 hours work may have begun and refunds are at our discretion.

After intake form submission

Once you submit your intake form we begin work on your song immediately. After intake form submission all sales are final except in the circumstances described below.

Eligible refund circumstances

We will issue a full refund only in the following circumstances:

• We fail to deliver your song within 48 hours of your intake form submission without providing a satisfactory explanation or revised delivery estimate.
• The delivered song contains content materially inconsistent with your intake form — for example the wrong names, a completely different music style than requested, or content that is offensive or inappropriate.
• A technical failure on our end makes the gift link permanently inaccessible and we are unable to resolve it within 24 hours.

Revision rounds

The Legacy tier includes one revision round. A revision means you may request one set of changes to the delivered song based on the original intake form. A revision is not a replacement song or a complete rewrite. Revision requests must be submitted within 48 hours of receiving the original song. Requests submitted after 48 hours will not be honored.

No refunds on streaming distribution

Streaming platform distribution, once initiated, is non-refundable regardless of outcome. See Section 7 for full streaming terms.

5. Intellectual Property and Ownership

VibePop retains all underlying rights

VibePop retains all underlying intellectual property rights in every song we create, including the composition, the production, and the audio recording. This is true regardless of which tier you purchase.

Retaining underlying rights allows VibePop to maintain its distribution relationships, manage streaming platforms, and operate as a business. This does not limit your ability to use your song personally in any meaningful way — it simply means VibePop holds the legal framework around the work.

What you receive — personal use license

By completing a purchase you receive an irrevocable, perpetual, worldwide license to use your song for personal purposes. This license does not expire. It cannot be taken back. The song is yours to keep and use personally for the rest of your life.

Your personal use license includes the right to:

• Keep and play your song on any personal device forever.
• Share your song with friends, family, and on personal social media accounts.
• Use your song at personal events such as weddings, birthdays, anniversaries, and celebrations.
• Post your song publicly on social media for personal, non-commercial purposes.
• Gift or forward your song to the intended recipient or anyone else.

What the personal use license does not include

Your license does not include the right to:

• Sell or commercially license the song to any third party.
• Claim the song as an original composition in any commercial, competitive, or professional music context.
• Use the song in advertising, brand campaigns, or any commercial content without written permission from VibePop.
• Register the song with any performing rights organization or copyright authority in your own name.
• Reproduce or distribute the song in a way that competes with VibePop's business.

A note on AI-assisted music and copyright

Songs created using AI-assisted music production technology occupy an evolving area of intellectual property law. The US Copyright Office has indicated that works produced with significant AI involvement may have limited or no traditional copyright protection. Because of this, VibePop does not represent or warrant that your song carries a registerable copyright. What we do grant you is a clear, irrevocable personal use license that gives you everything you practically need — the right to keep it, share it, play it, and enjoy it forever.

Content you provide

You represent and warrant that all story details, names, and other content you provide in the intake form are information you have the right to share. VibePop uses this information solely to create your song and will not share your story details with third parties except as required to produce your order.

6. Your Responsibilities

Accuracy of information

You are responsible for the accuracy of all information submitted in the intake form. VibePop creates songs based on what you tell us. We are not responsible for songs that do not meet expectations due to inaccurate or incomplete submissions.

Appropriate use

You agree not to use VibePop's service to create songs that contain or promote hate speech, harassment, threats, or harmful content targeting any individual. You agree not to request songs that impersonate real public figures in a misleading or defamatory manner. You agree not to use VibePop's service for any unlawful purpose.

VibePop reserves the right to decline any order at our discretion and issue a full refund if we determine the requested content violates these terms or our values.

Gift recipient consent

You are responsible for ensuring that sharing a personalized song with a recipient is appropriate given your relationship. VibePop is not responsible for how recipients respond to receiving a personalized song.

7. Streaming Platform Distribution — Legacy Tier Only

This section applies only to customers who purchase the Legacy tier.

How distribution works

Legacy tier customers receive distribution of their VibePop song to major streaming platforms including but not limited to Spotify, Apple Music, and Amazon Music. Distribution is managed by VibePop through a third-party music distribution service. The song is uploaded under a VibePop artist imprint with your song title and recipient details included in the track metadata where possible.

Platform policies

Streaming platform availability is subject to each platform's content policies, which may change at any time without notice. VibePop cannot guarantee that any specific platform will publish or maintain your song. Policies regarding AI-assisted music content are actively evolving across all major streaming platforms.

By purchasing the Legacy tier you acknowledge and accept that:

• Platform acceptance is not guaranteed. VibePop will submit your song in good faith but cannot guarantee acceptance by any platform.
• Platform availability may change. Even if your song is published, platforms may remove it at any time due to policy changes, rights disputes, or reasons outside VibePop's control.
• VibePop will notify you if your song is declined or removed from any platform. Refunds will not be issued for platform decisions.

Streaming royalties and income

VibePop retains all streaming royalties, performance income, and revenue generated by your song on streaming platforms. This income covers our distribution fees, ongoing account maintenance, and administrative costs.

By purchasing the Legacy tier you acknowledge that you are paying for streaming presence and distribution — the gift experience, the MP3 download, and the permanent availability of your song on streaming platforms — and not for streaming royalty income.

Content compliance

By purchasing the Legacy tier you confirm that the content of your song does not infringe the intellectual property rights of any third party, does not impersonate any real person in a misleading or defamatory way, and does not violate any applicable law or platform policy. You agree to indemnify VibePop against any claim arising from third-party rights violations in the content you requested.

Streaming timelines and availability

Once VibePop submits your song for streaming distribution, the time required for your song to become available on any platform is determined entirely by that platform and is outside VibePop's control. Typical processing times range from 3 to 30 business days depending on the platform. VibePop does not guarantee a specific date on which your song will become available.

Once live, your song will remain available on streaming platforms for an indefinite period, subject to VibePop maintaining its active distribution account and the platform not removing the content under its own policies. VibePop does not guarantee permanent or lifetime availability on any streaming platform. If VibePop discontinues its distribution service for any reason we will provide reasonable notice and where possible transfer or deliver the audio files directly to affected customers.

Takedowns

If VibePop receives a valid intellectual property or rights claim against your song we reserve the right to remove it from streaming platforms immediately and without notice. Refunds will not be issued in this circumstance.

8. Privacy

Information we collect

We collect your name, email address, payment information processed through a secure third-party processor, and the story and personal details you provide in the intake form.

How we use your information

We use your information to create your song, deliver your order, send order confirmation and delivery notifications, and respond to customer service inquiries.

We do not sell your personal information to third parties. We do not use your story details for marketing without your explicit consent.

Email communications

By placing an order you agree to receive transactional emails related to your order. You may opt out of non-transactional marketing emails at any time.

9. Disclaimers and Limitations of Liability

Service provided as-is

VibePop provides its service on an as-is basis. We make no warranties, express or implied, beyond what is stated in these terms.

Creative output

Music and creative work are subjective. VibePop does not warrant that any customer or recipient will find the delivered song to their taste. Our obligation is to deliver a song that reflects the intake form you submitted, not to guarantee a particular aesthetic or emotional outcome.

Limitation of liability

To the maximum extent permitted by applicable law, VibePop's total liability to you for any claim arising from these terms or your use of our service is limited to the amount you paid for the order giving rise to the claim. VibePop is not liable for any indirect, incidental, special, consequential, or punitive damages.

Third-party platforms

VibePop is not responsible for the actions, policies, or decisions of any third-party platform or service. Your use of any third-party platform is governed by that platform's own terms.

10. Governing Law and Disputes

These terms are governed by the laws of the State of Texas. Any dispute arising from these terms or your use of VibePop's service will be resolved through binding arbitration in Houston, Texas, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit against VibePop.

If any provision of these terms is found to be unenforceable the remaining provisions remain in full force and effect.

11. Changes to These Terms

VibePop reserves the right to update these terms at any time. Material changes will be communicated by updating the effective date at the top of this page. Orders placed before a change in terms are governed by the terms in effect at the time of the order.
